Terms of Service

Flex Credit is operated by FinFi Trust Co, LLC (“FinFi Trust,” “we,” “us,” or “our”), a Delaware limited liability company. FinFi Trust Co, LLC is a subsidiary of GOFINFI Corporation, a Delaware corporation. These Terms of Service (“Terms”) govern your access to and use of the Flex Credit program and related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About the Service
Flex Credit is a consumer credit monitoring and credit building program. The Service allows you to:
- Monitor your credit score and credit report information;
- Build credit history through reported payment activity;
- Access educational resources about credit management; and
- Receive notifications about changes to your credit profile.
FinFi Trust Co, LLC is the operator of the Service. FinFi Trust is responsible for the operation, governance, and compliance of the program. FinFi Trust is not a lender, does not make credit decisions, and does not provide loans or financing.
2. Eligibility
To use the Service, you must:
- Be at least 18 years of age;
- Be a resident of the United States;
- Have a valid Social Security Number or Individual Taxpayer Identification Number (ITIN);
- Successfully complete identity verification; and
- Agree to these Terms and the Privacy Policy.
We reserve the right to refuse service or terminate your account if you do not meet these requirements or if we determine, in our sole discretion, that your use of the Service poses a risk of fraud, abuse, or regulatory non-compliance.
3. Account Registration and Identity Verification
3.1 Account Creation
To create an account, you must provide accurate, current, and complete information including your legal name, date of birth, Social Security Number or ITIN, address, email address, and phone number. You are responsible for maintaining the accuracy of your information and the security of your account credentials.
3.2 Identity Verification
As part of the enrollment process, you will be required to verify your identity. This may include providing a government-issued photo identification document and completing a biometric verification check (such as a selfie or liveness check).
Identity verification is performed using third-party service providers on behalf of FinFi Trust. You consent to the collection, processing, and verification of your identity information as described in our Privacy Policy.
3.3 Verification Failure
If your identity cannot be verified, you will not be able to access the Service. We are not obligated to disclose the specific reason for a verification failure. You may contact us to inquire about the status of your verification.
4. Subscription and Payment
4.1 Subscription Plans
The Service is offered on a subscription basis. Available plans, pricing, and billing frequency are presented during enrollment and may be updated from time to time. You will be notified of any changes to your subscription terms before they take effect.
4.2 Billing
By subscribing, you authorize us to charge the payment method you provide on a recurring basis according to your selected plan. All fees are stated in U.S. dollars.
4.3 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods unless required by applicable law.
4.4 Free Trials
If a free trial is offered, your payment method may be charged at the end of the trial period unless you cancel before the trial expires. Trial terms will be disclosed at the time of enrollment.
5. Consent to Access Consumer Report Information
5.1 Authorization
By enrolling in the Service and clicking “Authorize” (or similar affirmative action), you authorize FinFi Trust Co, LLC to obtain your consumer credit report and other information about you from one or more consumer reporting agencies (including Experian, TransUnion, and/or Equifax) for the following purposes:
- To provide you with credit monitoring and credit score tracking services;
- To display your credit information within the Service;
- To help you understand and improve your credit profile; and
- To provide ongoing account servicing and notifications.
5.2 Soft Inquiry
Access to your credit report through the Service constitutes a “soft inquiry” (also known as a “soft pull”) and will NOT affect your credit score.
5.3 Ongoing Authorization
This authorization remains in effect for as long as you maintain an active account, unless you revoke it by contacting us or closing your account. You may revoke this authorization at any time by contacting support at the address provided in Section 15.
5.4 Credit Data Furnishing Consent
By enrolling in the Service, you also consent to the reporting of your payment activity to one or more consumer reporting agencies. This reporting is designed to help you build credit history. Reported information may include your account status, payment history, and account balance.
6. Consumer Reports and Credit Data
6.1 How We Use Consumer Reports
We access your consumer credit report information to provide the following services:
- Credit Score Display. We retrieve and display your credit score(s) from one or more consumer reporting agencies. Scores displayed may be based on the VantageScore or FICO scoring model, as applicable.
- Credit Report Summary. We retrieve and display a summary of your credit report, which may include account information, payment history, public records, and inquiry history.
- Credit Monitoring. We periodically access your credit report to identify changes and notify you of significant activity, such as new accounts, hard inquiries, or changes to your score.
- Credit Building. Through your subscription, your payment activity is reported to consumer reporting agencies to help you establish or improve your credit history.
6.2 Accuracy of Information
The credit information displayed within the Service is obtained from third-party consumer reporting agencies. We do not independently verify the accuracy of information contained in your credit report. If you believe any information is inaccurate, you have the right to dispute it directly with the consumer reporting agency. See Section 8 for dispute procedures.
6.3 Permissible Purpose
We access your consumer report information with your consent and for the permissible purposes described in the Fair Credit Reporting Act, 15 U.S.C. § 1681b, including providing credit monitoring services at your request.
7. Your Rights Under the Fair Credit Reporting Act (FCRA)
Under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.), you have the following rights:
- Right to Know What Is in Your File. You have the right to request a copy of your consumer report from each of the nationwide consumer reporting agencies. You are entitled to one free report per year from each agency. Request your free report at www.annualcreditreport.com.
- Right to Dispute Inaccurate Information. If you believe that information in your credit file is inaccurate, you have the right to dispute it with the consumer reporting agency and/or the information furnisher. See Section 8 for dispute procedures.
- Right to Have Inaccurate Information Corrected or Deleted. Consumer reporting agencies must correct or delete inaccurate, incomplete, or unverifiable information, generally within 30 days of receiving your dispute.
- Right to Know Who Has Accessed Your Report. You have the right to know who has requested your consumer report within the past year (two years for employment inquiries).
- Right to Limit Pre-Screened Offers. You may opt out of pre-screened credit and insurance offers by calling 1-888-5-OPT-OUT (1-888-567-8688) or visiting www.optoutprescreen.com.
- Right to Seek Damages. If a consumer reporting agency, user, or furnisher violates the FCRA, you may be entitled to sue in state or federal court.
- Identity Theft Protections. If you are a victim of identity theft, you have additional rights, including the right to place a fraud alert or credit freeze on your file.

8. Disputes
8.1 Disputing Information on Your Credit Report
If you believe that information on your credit report is inaccurate or incomplete, you may file a dispute with:

We will investigate and, where applicable, coordinate with the relevant consumer reporting agency to correct or update the information.
8.2 Dispute Process
When you file a dispute, the consumer reporting agency must investigate the dispute, generally within 30 days. If the information is found to be inaccurate, it will be corrected or removed.
8.3 Disputes About the Service
If your dispute concerns the operation of the Service itself (rather than information on your credit report), contact us using the information in Section 15.
9. Data Security and Retention
9.1 Security Measures
We implement industry-standard technical and organizational measures to protect your personal information and consumer report data, including:
- Encryption of data in transit using TLS 1.2 or higher;
- Encryption of sensitive data at rest;
- Access controls limiting who can access your information;
- Audit logging of access to consumer data; and
- Regular security assessments and monitoring.
9.2 Data Retention
We retain your personal information and consumer report data for as long as your account is active and for a reasonable period thereafter as necessary to:
- Comply with legal and regulatory obligations;
- Resolve disputes;
- Enforce our agreements; and
- Maintain records as required by the FCRA and other applicable laws.
When your data is no longer needed for these purposes, we will securely delete or anonymize it in accordance with our data retention policies.
9.3 Data Breach Notification
In the event of a data breach affecting your personal information, we will notify you in accordance with applicable state and federal law.
10. Electronic Communications and E-SIGN Consent
By using the Service, you consent to receive communications from us electronically, including emails, in-app notifications, and text messages. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
In accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.), you consent to the use of electronic records and signatures in connection with the Service.
You may withdraw your consent to electronic communications by contacting us. If you withdraw consent, your ability to use certain features of the Service may be limited or terminated.
11. Service Providers
We use third-party service providers to operate and support the Service. These providers act on our behalf and are contractually obligated to protect your information. Service providers may include:
- Identity verification services;
- Credit data and consumer reporting infrastructure;
- Payment processing services;
- Banking connectivity services;
- Cloud hosting and infrastructure providers; and
- Customer support tools.
Service providers process your information only as necessary to perform their functions and are not permitted to use your information for their own purposes.

12. Intellectual Property
The Service, including its design, features, content, and technology, is owned by FinFi Trust Co, LLC or its licensors. You may not copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent.
“Flex Credit” and “FinFi Trust” are trademarks or service marks of their respective owners. All other trademarks appearing in the Service are the property of their respective owners.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
- We do not warrant the accuracy, completeness, or timeliness of credit information obtained from third-party consumer reporting agencies.
- In no event shall FinFi Trust Co, LLC, its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
- Our total liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud or willful misconduct.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
14.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through binding arbitration in accordance with the rules of the American Arbitration Association, or in a court of competent jurisdiction in the State of Delaware.
14.3 Class Action Waiver
To the maximum extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
The “Last Updated” date at the top of these Terms indicates when the most recent changes were made.
